Cities should respect property owner rights
Many property owners in our area may not realize that they have the legal right under Texas law to petition their land out of a city’s extraterritorial jurisdiction (ETJ).
This law was designed to protect landowners from being indefinitely controlled by cities that do not provide them with services or representation.
Unfortunately, the City of Aubrey has failed to respect that right in my case.
I properly submitted a petition to have my property released from the ETJ, yet the city has neither approved my request nor corrected its records to show that my property is no longer under its ETJ authority.
This failure undermines both state law and the basic principles of property rights.
Landowners should not have to fight their city government simply to have their lawful petitions recognized.
I urge other ETJ property owners to review their rights and to insist that cities comply fully and transparently with the law.
